This End User License Agreement (“Agreement”) is a legal agreement between you ( “You, “Your” or “User”) and HishabPati at Flat: 3A, House: 50/51 Road: 03, Janata Housing, Ring Road, Dhaka 1207 ( “We”, “Us”, or “Our”) regarding your use of the HishabPati mobile application (“App”) for iOS and Android.
By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not download, install, or use the App.
Subject to the terms and conditions of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your business use on a compatible iOS device that you own or control.

The App and all rights, title, and interest in and to the App, including but not limited to all copyrights, patents, trademarks, and trade secrets, are and will remain the exclusive property of the HishabPati. This Agreement does not grant you any rights to use the Company’s trademarks, logos, or other proprietary marks.
Your use of the App is also governed by our Privacy Policy, which can be found at https://www.hishabpati.com/en/privacy-policy/ . By using the App, you consent to the collection and use of information as described in the Privacy Policy.
HishabPati may, from time to time, in its sole discretion, develop and provide updates to the App. These updates may include bug fixes, patches, enhanced functions and new versions. You agree that HishabPati has no obligation to provide any updates or to continue to provide or enable any particular features or functionality.
This Agreement is effective until terminated by you or HishabPati. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.
The App is provided “as is” and “as available,” without warranty of any kind. To the maximum extent permitted by applicable law, the Company disclaims all warranties, whether express, implied, or statutory, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. HishabPati does not warrant that the App will meet your requirements, operate without interruption, or be error-free.
To the maximum extent permitted by applicable law, in no event will HishabPati be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
(i) Your use or inability to use the App.
(ii) Any unauthorized access to or use of our servers and/or any personal information stored therein.
(iii) Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.
This Agreement shall be governed by and construed in accordance with the laws of People’s Republic of Bangladesh & international laws, without regard to its conflict of laws principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the federal or state courts located in People’s Republic of Bangladesh, and you hereby consent to the personal jurisdiction and venue therein.
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the App after any such changes constitutes your acceptance of the new terms.
We may associate any separate Terms of Use or any other documentation to govern the App. You may check from time to time its attachments and associated documentation however your use of App makes sure you are fully aware about the documentation of the App.
HishabPati may charge you if you purchase our paid services. You also agree to any terms (such as a minimum term of service, recurring subscription fees, refund policy or payment terms) of which we notify you during your purchase of the product or services. We may change the rates at any time without notice to you. You agree that, by continuing to use the product or service following the adjustments of the rate(s), you accept the new rate(s). For the subscription purpose or any of the options available on the app we may collect your credit/debit card information for the sole purpose of collection of fee and your information shall be protected under our privacy policy as mentioned herein.
By using our services, you agree to receive electronic communications from us. These communications are part of your relationship with us and will include account-related notices (e.g., confirmations, alerts, message notifications, and other transactional messages) as well as App-related information, such as updates, new features, and other important account or service information.
To protect your personal information, access to the App needs the submission of login and pin credentials. The login and pin credentials are for your personal use alone and cannot be transferred. You may not share your login or pin credential with anybody else. You acknowledge that you are responsible for keeping your pin confidential and for any action that occurs as a result of allowing or permitting any person or entity to use your pin. You undertake to tell us promptly if: (i) your pin is lost or stolen, or (ii) you become aware of any unauthorized use of your password or any other security breach involving the App. We are not liable for any loss or damage arising from your failure to comply with the provisions of this section.
We may be included into third-party services and technologies. Any and all other third-party programs or technology supplied with the App will be subject to your explicit acceptance of a license agreement with that third party as well as the terms of this EULA. You understand and agree that you will not enter into a contract with us or our affiliates.
